Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and PrettySure (“PrettySure,” “we,” “us”) governing your use of the PrettySurewebsite and app (the “Service”). Please read them together with our Privacy Policy. By creating an account or using the Service, you agree to these Terms.

1. Who can use PrettySure

You must be at least 18 years old and the parent or legal guardian of any child you add. By creating an account you confirm this, you agree to these Terms and our Privacy Policy, and you consent on your child's behalf to the collection of their information as described in our Children's Privacy notice.

2. What PrettySure is

PrettySure is a family motivation tool. Parents set a weekly reward and quests; children complete quests and parents approve submissions. PrettySure tracks progress only.

3. Rewards are not handled by us

PrettySure does not transfer money, hold funds, issue cards, or provide any financial service. Any reward, including allowance amounts shown for convenience, is arranged and provided by you, offline, at your discretion. Figures in the app are tracking aids, not a balance you can withdraw.

4. Subscriptions, billing & auto-renewal

PrettySure offers a free tier and a paid Family Premium plan. Premium is $9.99 per month or $89.99 per year, and new Premium subscriptions may start with a 14-day free trial.

• Auto-renewal. Paid plans and free trials automatically renew at the price above until you cancel. By starting a plan or trial you authorize our payment processor (Stripe) to charge your payment method each period.
• Trial reminders. If your plan includes a free trial, we email a reminder at least 3 days beforethe trial ends and your first charge. Cancel before the trial ends and you won't be charged.
• Cancellation.Cancel anytime from your account's billing page. It's as easy as signing up. Premium access continues until the end of the period you already paid for; we don't provide partial-period or pro-rated refunds except where required by law.
• Price changes.We'll notify you before any change to your renewal price; continued use after it takes effect is your acceptance.
• Reward fulfillment.Where available, fulfilling a reward (e.g. a gift card or game-currency code) is a purchase processed through a third-party provider and is subject to that provider's and the brand's terms.
• App-store purchases. If you subscribe through the Apple App Store, Google Play, or Amazon Appstore, that store handles billing and renewals under its own terms, and you manage or cancel through that store.

5. Your account

Keep your password confidential and your contact email current. You are responsible for activity under your account, including your child's use of the app on your device. Notify us promptly at support@prettysure.io if you suspect unauthorized use.

6. Acceptable use

• Don't upload unlawful, harmful, or inappropriate content, including in quest photos.
• Don't attempt to break, probe, scrape, overload, or misuse the service or other families' data.
• Only add children for whom you are the parent or guardian.
• Don't resell, reverse-engineer, or use the Service to build a competing product.

7. Your content

You and your child keep ownership of photos and text you submit. You grant us a limited, non-exclusive license to store and display that content solely to operate PrettySurefor your family. We don't use it for advertising or share it for others' marketing.

8. Our intellectual property

The Service, including its software, design, content, and the PrettySure name and logo, is owned by PrettySure and protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to use the Service for your family in accordance with these Terms. All rights not expressly granted are reserved.

9. Electronic communications

We send account, security, billing, and (if you opt in) digest emails related to your use of the Service. These are part of the Service and you may receive them even if you opt out of optional updates. You consent to receive communications from us electronically.

10. Availability

PrettySureis provided “as is” and may change or have downtime. We don't guarantee uninterrupted or error-free service.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or be secure, uninterrupted, or error-free.

12. Limitation of liability

To the fullest extent permitted by law, PrettySureand its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, or for any reward or allowance you choose to provide. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless PrettySure from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Termination

You may stop using PrettySureand delete your account at any time. We may suspend or terminate accounts that violate these Terms or to protect the Service or its users. Provisions that by their nature should survive (such as sections 7–13 and 15) will survive termination.

15. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing a claim, you agree to first contact us at support@prettysure.io and try in good faith to resolve the dispute informally. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction. To the extent permitted by law, you and we agree that claims will be brought only in an individual capacity and not as part of a class action.

16. General

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. We may assign these Terms in connection with a merger or sale; you may not assign them without our consent. Our failure to enforce a provision is not a waiver. We are not liable for delays or failures caused by events beyond our reasonable control.

17. Changes

We may update these Terms; we'll revise the date above and notify you of material changes.
